    General terms and conditions

    1. SCOPE OF APPLICATION

    These General Terms and Conditions govern the relationship between the Customer (hereinafter referred to as «Customer») and Zoo Zürich AG (hereinafter referred to as «Zoo Zurich»). The offer to enter into a contract is made by the Customer in each case by submitting a request to purchase an admission ticket for a visit to the Zurich Zoo, a related service or goods to the Zurich Zoo. The conclusion of the contract between the Customer and the Zurich Zoo is effected by the acceptance of this request by the Zurich Zoo.

    The term «Customer» is used to refer to any natural or legal person who does business with Zoo Zurich. The GTC may be amended from time to time.

    Should individual provisions of these GTC prove to be invalid or unenforceable, or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

    2. TICKETS

    The Zoo Zurich may only be entered with a valid ticket. The tickets entitle the holder to enter and stay at Zoo Zurich during the designated opening hours.

    Tickets must be presented or cancelled upon entry to Zoo Zurich and must be carried on the premises of Zoo Zurich thereafter. Resale of tickets or any other commercial use is prohibited. For online tickets, the «GTC of the Online Ticket Shop» apply in addition.

    3. CONDITIONS

    3.1 Prices

    The prices for the purchase of a ticket, a related service or merchandise of Zoo Zurich can be found in the current price lists of Zoo Zurich or on notices posted on site or on the Internet. Unless otherwise stated, all prices include VAT. Prices are subject to change without notice.

    Tickets purchased without authorization or misused shall lose their validity and must be returned to Zoo Zurich without replacement. Criminal charges may be brought against the persons concerned.

    The issue of discounted individual and group tickets, e.g. to kindergartens, schools and social institutions, requires appropriate proof of entitlement.

    3.2 Complaints

    The customer is obliged to check the ticket, service or goods immediately upon receipt to ensure that they are correct or free of defects. The complaint can be made in person, by telephone or in writing (e-mail or letter). If the customer fails to check the ticket, service or goods immediately upon receipt and to make a corresponding complaint, the zoo's performance shall be deemed to have been approved.

    3.3 Terms of payment

    The cost of the purchase of a ticket, related service or merchandise may be paid on the spot in cash or with a credit or debit card accepted by Zoo Zurich or with vouchers or vouchers accepted by Zoo Zurich. Payment on account is only possible after consultation with the Zoo Zurich (payment period strictly net without deductions: 30 days). A processing fee of CHF 5 is due on invoiced amounts. Invoice payment is generally only possible in Swiss francs.

    4. FURTHER PROVISIONS

    4.1 General safety regulations

    Safety has the highest priority. During his stay, the customer, together with the zoo staff, must ensure that the highest possible level of safety is maintained. Emergency exits and escape routes must always be kept completely clear. In the event of ambiguities, technical problems, extraordinary occurrences or damage, the day manager must be contacted and informed immediately, either directly or via a zoo employee.

    Customers must observe the instructions for use, operating manuals and instructions issued by zoo staff. Should they fail to comply with these instructions, the zoo staff may exclude them from the use of the facility or expel them from the zoo premises, without this giving rise to any claim for compensation. Zoo Zurich shall not be liable for any damage caused by violations or non-compliance with the information, instructions or directions.

    Any alterations to or climbing on the exhibits other than the objects and attractions provided for this purpose are strictly prohibited. In order to protect the objects, touching is to be refrained from.

    All technical installations and set-ups by the Customer, his guests or third parties commissioned by him must be agreed with Zoo Zurich in advance and recorded in writing. Furthermore, no heat-generating lighting may be directed at exhibits.

    4.2 Duty of supervision

    Children under 12 years of age may only enter Zoo Zurich when accompanied by an adult. We ask parents or guardians to fulfil their supervisory duties with due care. If parents or guardians do not fulfil their supervisory duties, they are liable for all damage caused by the children.

    4.3 Immissions and restrictions

    The Customer is aware that Zoo Zurich is constantly being rebuilt and that certain emissions and restrictions are therefore unavoidable during the Customer's visit. The assertion of claims for damages or compensation in this regard is hereby explicitly excluded.

    Should Zoo Zurich be unable to operate due to force majeure (incl. epidemics, pandemics and other events affecting health) or measures imposed by the authoritiesnur restricted (e.g. only the outside areas of the zoo, but not the animal houses), the assertion of animal houses), the assertion of claims for damages or compensation in this regard is hereby explicitly excluded.

    In the event of a complete closure of the zoo due to force majeure (incl. epidemics, pandemics and other events affecting health) or official regulations exists duringduring the first 30 daysn of a closure there is also no claim for damages or compensation.e.

    4.4 Attractions and facilities

    Zoo Zurich always endeavors to keep the availability of attractions and facilities as high as possible. In consideration of the animals and for other reasons, such as weather conditions, maintenance and construction work or capacity reasons, etc., the purchase of an admission ticket does not imply any entitlement to specific services such as the presentation of certain animals or animal species or the possibility of using all attractions at Zoo Zurich at all times. The presentation times are published on the websitewww.zoo.ch/veranstaltungen and on site. The right to make changes at short notice is reserved. The unavailability of attractions and/or facilities does not entitle the user to claim damages or compensation from Zoo Zurich.

    4.5 Catering

    The restaurants at the zoo are operated by Zoo Restaurants GmbH. Eating and drinking are only permitted in the restaurants and in the premises provided for this purpose.

    4.6 Advertising, sales and giveaways

    All advertising and sales of services and goods are prohibited on the zoo premises during opening hours. The distribution of gifts and information material is also prohibited. Exceptions may be made by prior arrangement and with the written consent of Zoo Zurich.

    4.7 Parking

    Parking is only permitted in the defined and marked parking areas. Vehicles belonging to suppliers, event organizers and visitors are to be parked in the public parking lots around Zoo Zurich. Zoo Zurich accepts no liability or responsibility for damage to or fines imposed on parked vehicles. Unauthorized parked vehicles will be towed away at the owner's expense.

    4.8 Vehicles on zoo premises

    The use of non-zoo vehicles of any kind on the premises of Zoo Zurich is only permitted with exceptions and after consultation with Zoo Zurich. All buildings may only be entered by Zoo staff or by persons accredited by the Zoo. Riding bicycles, running bikes (LIKEaBIKE), kickboards, inline skates, skateboards, etc. is prohibited. Playing with balls, frisbees, balloons, etc. is also prohibited.

    In the interest of safety and to protect all customers from unreasonable disturbance, Zoo Zurich reserves the right to prohibit the bringing of other objects/articles that may cause disturbance to other customers and/or the animals and/or zoo staff.

    4.9 Smoking

    Smoking is permitted outdoors or in designated «smoking zones» at Zoo Zurich. Out of consideration for animals and zoo visitors, smoking is prohibited in all buildings and animal houses and at the entrances to Zoo Zurich, the animal houses and the zoo restaurants as well as in walk-in animal enclosures (outdoor enclosure Australia, Saimiri Island, Ibis Volière). This also applies to e-cigarettes.

    4.10 Animals

    Dogs and other animals are not allowed in Zoo Zurich. No dog crates are available, with the exception of marked guide dogs for the blind and marked assistance dogs for people with motor disabilities.

    4.11 Handling and feeding animals

    Stepping over the barriers and reaching into the animal enclosures endangers animals and humans and is strictly prohibited. Animals also need rest breaks. Loud shouting and banging on windows is prohibited.

    Keeping the animals in a manner appropriate to their species and their health can only be guaranteed if the animals are fed exclusively by zoo staff. It is therefore absolutely forbidden to feed the animals, except in enclosures where food is offered by Zoo Zurich. The Zoo Zurich reserves the right to expel customers who violate the feeding ban from the Zoo Zurich and to exclude them from the Zoo Zurich in the future.

    4.12 Photography, filming

    Photography and/or filming for private purposes is encouraged. Please note the flash ban in some houses.

    Any publication and/or commercial use of private images and films from Zoo Zurich, e.g. on Internet websites, in publicly accessible and/or commercial databases, etc., is only permitted upon presentation of proof of the image or film and only with the express prior written consent of Zoo Zurich.

    Drone flights for film/photographic purposes are not permitted over the entire zoo premises.

    4.13 Opening hours

    Please note the opening hours of Zoo Zurich. We would like to point out that staying after zoo closing time is not permitted except during guided tours and closed events.

    4.14 Waste

    Please help to keep Zoo Zurich clean. Please use the waste bins provided.

    5. LIABILITY

    Zoo Zurich excludes all liability for damages (personal injury or bodily harm) incurred directly or indirectly as a result of this contract, i.e. the visit to Zoo Zurich, a related service or the purchase of goods, to the extent permitted by law, irrespective of the legal grounds on which the damages are claimed. Likewise, Zoo Zurich excludes any non-contractual liability for direct or indirect damage (personal injury or bodily harm) to the extent permitted by law, irrespective of the legal grounds on which the damage is claimed.

    Zoo Zurich accepts no liability for theft.

    6. FINAL PROVISIONS

    6.1 Place of jurisdiction and applicable law

    Swiss substantive law shall apply exclusively, to the exclusion of the provisions of international private law and in particular the Vienna Sales Convention. The place of jurisdiction for all disputes is Zurich.

    6.2 Applicability of further provisions

    The «GTC Events Zoo Zürich AG & Zoo Restaurants GmbH» shall apply to all products and services of the Event Department of Zoo Zürich AG and Zoo Restaurants GmbH.

    The «GTC Courses & Seminars Zoo Zürich AG» shall apply to courses and seminars offered by Zoo Zurich.

    For the purchase of tickets in the Zoo Zurich Online Ticket Shop, the «GTC Online Ticket Shop» apply.

    The «GTC Zoo Zurich Online Shop» apply to purchases made in the Zoo Zurich Online Shop.

    6.3 Updating General Terms and Conditions

    The General Terms and Conditions of Zoo Zürich AG are an integral part of the customer relationship. Zoo Zurich reserves the right to adapt the General Terms and Conditions due to changes in the general conditions. The last adjustment of these General Terms and Conditions is dated August 30, 2020.

    1. PURPOSE AND RENTAL OF ZOO ZÜRICH PREMISES

    These Terms and Conditions apply to all events held at Zoo Zurich and to all other related services provided by Zoo Zürich AG and Zoo Restaurants GmbH (hereinafter referred to as «Zoo Zurich»).

    General terms and conditions or similar terms and conditions of the Event Organizer shall apply only to the extent that they have been explicitly accepted by Zoo Zurich in writing.

    Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

    The contract between the Organiser and Zoo Zurich shall only be concluded upon written confirmation of the order by Zoo Zurich. The General Terms and Conditions shall form an integral part of the contract and shall be deemed accepted upon delivery of the order confirmation. Verbal agreements or commitments require written confirmation by Zurich Zoo in order to be valid.

    Various locations (animal houses, aperitif stands, restaurants) can be rented for aperitifs and banquets, workshops can be held at Zoo Zurich and guided tours can be booked.

    All guests present at the event pay for the guided tour, even if they did not participate.

    Zoo Zurich attaches great importance to keeping the animals as close to nature as possible. This means that they can choose for themselves where they want to spend time in their enclosure. No guarantee is given that the animals will be in the vicinity of the guests during aperitifs, banquets, etc.

    2. PRICES AND CONDITIONS

    The current price list of Zoo Zurich atwww.zoo.ch applies. Zoo Zurich reserves the right to adjust the price list at any time. Free tickets and annual subscriptions are not valid for guided tours and event services.

    2.1 Method of payment

    Zoo Zurich has the right to demand a deposit in the amount of the expected total turnover at any time, payable upon signing of the contract. The remaining amount is due for payment within 30 days after receipt of the final invoice (expiry date).

    In the event of late payment, Zoo Zurich shall be entitled to charge interest on arrears at a rate of 5% from the due date without further reminder.

    3. REGULATIONS IN THE EVENT OF CHANGES IN THE NUMBER OF PERSONS

    3.1 Guided tours

    Changes in the number of participants must be communicated in writing no later than two weeks prior to the guided tour. After this date, in the event of a reduction in the number of participants resulting in a reduction in the number of guides scheduled, the cost of the guides no longer required will be invoiced. If desired, the original number of guides can be retained for the reduced number of participants.

    3.2 Workshop/mini-trekking/children's birthday party

    Any changes to the number of participants must be notified in writing at least two weeks before the event.

    3.3 Catering restaurants, animal houses and nature workshop

    The number of persons listed in the written order confirmation is the basis for calculating the costs and is binding. The Organiser is obliged to inform Zoo Zurich of the definitive number of participants up to 72 hours before the event. The Organiser shall be entitled to deviate from the confirmed number of persons by up to a maximum of 20% up to 72 hours before the event. In this case, Zoo Zurich will charge the costs for the changed, effective number of persons.

    Up to 12 noon on the day before the event, Zoo Zurich will accept a difference of 5% of the definitive number of persons. In the event of an increase in the number of persons, Zoo Zurich shall be entitled to invoice the costs for the effective number of persons. In the event of a reduction in the number of persons, the Organiser shall be charged the costs for the agreed number of persons, but at least the costs for the minimum consumption in accordance with the order confirmation.

    4. REBOOKINGS

    4.1 Fear seminar, photo course, experience voucher, night walk

    Rebookings are possible up to four weeks before the agreed date and subject to availability and cost CHF 50.

    4.2 Guided tour, workshop, children's birthday party, mini-trekking

    Rebookings are possible up to 15 days before the guided tour and cost CHF 50. After this date, the cancellation conditions apply (see point 5).

    5. CANCELLATION OF THE CONTRACT

    If the definitely confirmed event is cancelled, it must be cancelled in writing as soon as possible. The costs are determined as follows:

    5.1 Photo course, anxiety seminar

    If participation in the events mentioned in the title is cancelled for reasons beyond the control of Zoo Zurich, the course participant undertakes to reimburse the following costs:

    • up to the 30th day before the date of the event: CHF 100.00
    • from the 29th to the 15th day: 50% of the lost revenue
    • from the 14th day: 100% of the lost revenue, but at least CHF 100.

    5.2 Guided tour, workshop, children's birthday party, mini trekking

    If participation in the events mentioned in the title is cancelled for reasons beyond the control of Zoo Zurich, the Organiser undertakes to reimburse the following costs:

    • up to the 15th day before the date of the event: CHF 100.00
    • from the 14th - 8th day: 50% of the lost revenue
    • from the 7th - 1st day: 75% of the lost turnover
    • on the day of the tour: 100% of the lost turnover, but at least CHF 100.00

    The calculation basis for the lost turnover is in each case the turnover recorded in the order confirmation.

    5.3 Night tours

    If participation in the events mentioned in the title is cancelled for reasons beyond the control of Zoo Zurich, the Participant undertakes to reimburse the following costs:

    • up to the 28th day before the date of the event: CHF 100.
    • from the 27th-14th day: 50% of the lost revenue
    • from the 13th to the 8th day: 75% of the lost revenue
    • from the 7th day: 100% of the lost turnover, but at least CHF 100.-.

    5.4 Rental of restaurants, animal houses, nature workshop, Zoolino

    If the booked event is cancelled for reasons beyond the control of Zoo Zurich, the Organiser undertakes to reimburse the following costs:

    • Up to 90th day before date of event: CHF 100.
    • From 89-15th day: 10% of the lost rental fee
    • From the 14th to the 5th day: 50% of the lost rent
    • From the 4th day: 100% of the lost rent, but at least CHF 100.

    5.5 Catering (restaurants, animal houses and nature workshop, Zoolino)

    If the booked event is cancelled for reasons beyond the control of Zoo Zurich, the Organiser undertakes to reimburse the following costs:

    • up to 90th day before the date of the event: CHF 100.- (CHF 50.- for rebookings)
    • from the 89th - 30th day: 10% of the lost revenue excluding drinks
    • from 29th-15th day: 15% of the lost turnover without drinks
    • from 14.-5. day: 50% of the lost turnover without drinks
    • from 4th day: 100% of the lost turnover without drinks

    The calculation basis for the lost turnover is in each case the turnover recorded in the order confirmation with the minimum prices per menu.

    5.6 Delays to guided tours

    In the event of delays of up to 20 minutes, the delayed arrival time shall be deducted from the booked guided tour time. For delays of more than 20 minutes, the guided tour will be cancelled completely and charged at 100% according to the order confirmation.

    5.7 Adventure Voucher

    If the adventure voucher is cancelled for reasons beyond the control of Zoo Zurich, the adventure voucher shall be forfeited. The Participant shall not be entitled to an alternative date or a refund.

    6. CANCELLATION BY EVENT DEPARTMENT ZOO ZÜRICH AND ZOO RESTAURANT GMBH

    If Zoo Zurich has reason to believe that the event booked by the Customer will jeopardize the smooth running of the business, the safety or the reputation of the establishment, the event may be cancelled at any time without compensation.

    7. CATERING, MUSIC, ARTISTS AND LIGHTING

    The Organiser shall procure all catering services from Zoo Restaurants GmbH. The Organiser or event participants may not bring food and beverages to events. Exceptions to this rule require the prior written consent of zoo restaurants.

    Musical or other artistic performances are not permitted in animal houses or at outdoor locations in the animal areas. Various locations (indoors and outdoors) in Zoo Zurich are available for this purpose, subject to prior written agreement with Zoo Zurich.

    Any copyright compensation in connection with musical performances must be applied for and paid by the organiser.

    8. USER REGULATIONS

    The basic facilities for aperitifs, banquets and workshops are provided by Zoo Zurich. Any further arrangements must be made with Zoo Zurich in advance.

    Cloakrooms are available to guests in the animal houses and restaurants. Zoo Zurich accepts no liability for this.

    The use of the organizer's own electrical equipment requires the prior written consent of Zoo Zurich.

    The Organiser shall obtain any necessary official permits for the event in good time and at its own expense. The Organiser shall be responsible for compliance with public law requirements and other regulations as well as with the instructions of the Zoo Zurich.

    Deliveries of external material shall be made in winter (Nov.-Feb.) from 5 p.m. and in summer (March-Oct.) from 6 p.m. exclusively via the service roads. No lifting platforms, ladders or other means of transport are available. Dismantling must take place after the event or the next morning before 8.30 am. Transport by vehicle within the zoo premises requires a permit from Zoo Zurich and must be announced in good time.

    No advertising or logos may be placed in Zoo Zurich unless the entire Zoo Zurich is rented or the event takes place exclusively after the Zoo closes. In any case, the approval of the Zoo Zurich is required.

    Cleaning of the premises is included in the rental fee and is organized by Zoo Zurich.

    9. NIGHT EVENTS, NOISE EMISSIONS

    The organizer and the participants of the event must respect the privacy of the residents of the adjacent buildings. Any noise is to be avoided. The instructions from the animal area as well as the instructions from the zoo staff must be followed at all costs so that people and animals are not endangered.

    The organiser is obliged to observe and enforce the police night-time regulations.

    The agreements made with Zoo Zurich must be strictly adhered to. The organizer assumes full responsibility for any misconduct or claims by third parties as well as any resulting liability for damages. If claims are made against Zoo Zurich by third parties in this regard, the Organiser shall indemnify Zoo Zurich in full.

    10. DAMAGE, INSURANCE

    In the event of any disruptions or deficiencies in the services provided by the Zoo Zurich, the Zoo Zurich shall endeavor to remedy the same upon knowledge thereof or upon immediate complaint by the Organizer. The Organizer is obliged to do what is reasonable for it to do in order to remedy the disruption and keep any possible damage to a minimum.

    Zoo Zurich shall only be liable in the event of intentional or grossly negligent breach of contractual obligations. Any further liability for direct, indirect and consequential damages as well as liability for auxiliary personnel is excluded to the extent provided by law.

    The organiser shall in any case be liable for all damage caused to rooms, facilities, furniture, animals and the surrounding area and shall take out appropriate insurance. Furthermore, the organizer is liable for personal injuries of the event participants and must also take out appropriate insurance. The organizer is also liable for defective or missing objects.

    The organizer is also liable for damages caused by the event participants, his employees or third parties from his area.

    If claims are made against Zoo Zurich by third parties for damages arising from this contract, the Organiser shall fully indemnify Zoo Zurich.

    The insurance of objects brought along by the organizer, course or event participants is the responsibility of the organizer, course or event participant. Zoo Zurich may require proof of specific insurance policies.

    11. STAY AT THE ZOO AFTER CLOSING TIME

    Guests are not permitted to enter the Zoo grounds after closing time unless they have booked a guided tour or are accompanied by a Zoo employee. If this rule is disregarded, Zoo Zurich accepts no liability whatsoever.

    12. PHOTOGRAPHY, FILMING AND VIDEO RECORDING

    Photography, filming and video recording on the Zoo premises are permitted for private purposes. They may be restricted or prohibited for certain events. Photography, filming and video recording for commercial purposes are prohibited. Zoo Zurich is entitled to take possession of or delete any recordings made in this way at the expense of the Organiser or the participants in the event. In addition, the Organiser undertakes to fully indemnify Zoo Zurich for any damages arising therefrom.

    13. DATA PROTECTION

    The applicable provisions regarding data protection can be found in thedata protection statement of Zoo Zurich. The data protection statement is an integral part of the GTC Events Zoo Zürich AG & Zoo Restaurants GmbH.

    14. ADDITIONAL PROVISIONS

    If the Event Organizer is not also the Event Partner, the Event Organizer shall be jointly and severally liable with the Event Partner to Zoo Zuricho for all liabilities. Cases of force majeure (fire, strike, etc.) shall release the zoo from any obligation to perform.

    15. JURISDICTION

    The contract is subject to Swiss substantive law. The exclusive place of jurisdiction is Zurich.

    1. GENERAL PROVISIONS

    These Terms and Conditions apply exclusively to courses and seminars organized by Zoo Zürich AG (hereinafter referred to as «Zoo Zurich»). Other events such as guided tours, workshops, night walks, experience vouchers or night walks are governed by the «GTC Events Zoo Zürich AG & Zoo Restaurants GmbH».

    Validity: as of December 2018.

    Should individual provisions of these GTC prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

    We reserve the right to make changes to the General Terms and Conditions.

    2. SEMINARS AND COURSES

    2.1 Course Organization

    For organizational reasons, Zoo Zurich reserves the right to postpone or combine courses in consultation with the registered persons. Persons who are unable to attend the course as a result will be refunded the course fees already paid.

    If a course instructor drops out, a change of instructor can be made.

    2.2 Course places and implementation

    A minimum and a maximum number of participants will be determined for each course. Course places are allocated in the order in which registrations are received, subject to timely payment. If the number of participants is insufficient, the course or seminar will generally not be held and the course fee will be waived or refunded.

    3. PRICES AND CONDITIONS

    3.1 Prices and subscriptions

    The current course and seminar prices of Zoo Zurich at www.zoo.ch apply. Zoo Zurich reserves the right to adjust prices at any time. Free tickets and annual subscriptions are not valid for courses and seminars.

    3.2 Registration and payment

    Oral or written registration is binding and obligates the participant to pay the course fee. Non-payment of the course fee does not constitute cancellation.

    In the event of late payment, Zoo Zurich is entitled to charge interest on arrears at a rate of 5% from the due date without further reminder.

    4. REBOOKINGS

    Rebookings are possible up to four weeks before the agreed date and subject to availability and cost CHF 50. The same applies to groups who have booked a seminar or course.

    5. CANCELLATION OF THE CONTRACT

    Every registration is binding. Depending on the date of a proper, written cancellation, the course fee can be waived in whole or in part.

    5.1 Anxiety seminars and seminars/courses with groups

    If an individual cancels his/her participation in an anxiety seminar or a group cancels the booking of a group course/seminar for reasons beyond the control of Zoo Zurich, the individual is obligated to reimburse the following costs:

    • up to 30 days prior to the date of the event: CHF 100.00
    • from the 29th-15th day: 50% of the lost course fee
    • from the 14th day: 100% of the lost course fee, but at least CHF 100.

    5.2 Other courses and seminars

    If an individual cancels his/her participation in a course or seminar (except anxiety seminar, cf. para. 5.1.) for reasons beyond the control of Zoo Zurich, he/she is obliged to reimburse the following costs:

    • up to the 30th day before the date of the event: CHF 50.
    • from the 29th-15th day: 50% of the lost course fee, but at least CHF 50.-
    • from the 14th day: 100% of the lost course fee, but at least CHF 50.-.

    6. LATE ARRIVALS AND COURSES/SEMINARS NOT ATTENDED

    6.1 Late arrival of a group to a group seminar

    If a group is late for an event they have booked, the following procedure will apply: For delays of up to 20 minutes, the late arrival time will be deducted from the booked event time. In the case of delays of more than 20 minutes, the event shall be cancelled entirely and 100 % shall be invoiced in accordance with the order confirmation.

    6.2 Late arrival of individuals

    In the case of courses with individuals, the latter must arrive on time at the agreed meeting point. If necessary, they can wait a maximum of 5 minutes, after which the event will start. The costs for the course or seminar will be charged at 100% according to the order confirmation.

    6.3 Non-attended courses/seminars

    Courses or seminars not attended cannot be made up and will not be refunded or invoiced at 100% in accordance with the order confirmation.

    7. COURSE CONFIRMATION

    Upon request, a confirmation will be issued to participants after attending a course or seminar. The condition is that the event was held no longer than one year ago.

    8. DAMAGES, INSURANCE

    Zoo Zurich accepts no liability whatsoever for any damage incurred in connection with courses and seminars organized by Zoo Zurich. Participants are responsible for ensuring that they have adequate insurance coverage. The use of zoo facilities is at the participant's own risk. Zoo Zurich cannot be held liable for theft or loss of objects.

    Course/seminar participants may be held liable for grossly negligent damage to rooms, equipment, furniture, animals and grounds.

    9. PHOTO, FILM AND VIDEO RECORDINGS

    Photography, filming and sound recordings on the zoo premises are permitted for private purposes, but prohibited for commercial purposes. Zoo Zurich is entitled to take or delete any recordings made in this way. If the recordings are to be used commercially, permission must be obtained from Zoo Zurich.

    10. DATA PROTECTION

    The applicable provisions on data protection can be found in theData Protection Declaration of the Zoo Zurich. The data protection statement is an integral part of the GTC Courses and Seminars Zoo Zürich AG.

    11. PLACE OF JURISDICTION

    The contract is subject to Swiss substantive law. The exclusive place of jurisdiction is Zurich.

    1. SCOPE OF APPLICATION

    The following General Terms and Conditions (GTC) apply to the use of the Zoo Zurich Online Shop as well as to the business relationship between the Zoo Zurich and its Customers in the version currently available and valid when the Zoo Zurich Online Shop is accessed or when goods are ordered.

    The term «Customer» refers to any natural or legal person who has a business relationship with the Zoo Zurich. The GTC may be amended from time to time. Zoo Zurich requests that these terms and conditions be read carefully each time the Customer visits the Zoo Zurich Online Shop and orders goods.

    3. PRICES

    Unless otherwise stated, the prices quoted in the Zoo Zurich Online Shop include statutory value-added tax, any advance recycling fees (VRG) and copyright fees for electronic devices. Prices are quoted net in Swiss francs (CHF).

    The shipping and packaging costs of CHF 9.- are, where not otherwise provided for, charged additionally and are to be paid by the customer. Shipping costs are shown separately in the order process.

    We reserve the right to make technical changes, errors and misprints. In particular, Zoo Zurich may change prices at any time without prior notice. Consulting and support services are not included in the sales prices.

    4. CONCLUSION OF CONTRACT

    The offers on this website constitute a non-binding invitation to the Customer to order products and/or services from the Zoo Zurich Online Shop. By placing an order via this website, including acceptance of these GTC, the Customer submits a legally binding offer to conclude a contract. Zoo Zurich shall then send an automatic «Order Confirmation» by e-mail confirming that the Customer's offer has been received by the Zoo Zurich Online Shop. Orders placed are binding for the Customer. Unless otherwise stated, there is no right of return or withdrawal.

    The contract is concluded as soon as Zoo Zurich has sent the «Order Confirmation» by e-mail.

    Orders will only be delivered after full payment has been received and provided that the goods are available. If it becomes apparent after the conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, Zoo Zurich shall be entitled to withdraw from the entire contract or from a part of the contract. If the Customer's payment has already been received by Zoo Zurich, the payment shall be refunded to the Customer. If no payment has yet been made, the Customer shall be released from the obligation to pay. In the event of a cancellation of the contract, Zoo Zurich shall not be obliged to make a replacement delivery.

    5. PAYMENT OPTIONS AND RETENTION OF TITLE

    The Customer may use the payment options indicated in the order process.

    a) Electronic means ofpayment
    Credit card (Visa, Mastercard, American Express), TWINT and debit card (Postcard) are accepted as means of payment. If payment is made by credit card or debit card, the amount will be debited after the goods have been dispatched.

    b) Purchase on account
    The Online Shop may, at its own discretion, offer payment on account (with or without an instalment payment option). It may make this method of payment dependent on a positive credit check and other conditions determined at its own discretion (e.g. minimum age, Swiss residence). The customer has no right to payment on account or payment by instalments.

    The customer acknowledges that a credit check may be carried out as part of the conclusion of the contract and that personal data may be recorded for this purpose and passed on to Intrum AG, the company commissioned to carry out the credit check.

    In the case of payment against invoice, the Online Shop assigns the purchase price claim to the payment partner Byjuno AG. The payment is processed by Byjuno AG and the customer receives the invoice directly to the e-mail address provided by the customer when placing the order. The invoice amount must be paid directly to Byjuno AG within 20 calendar days of the invoice date. In the event of late payment, interest on arrears and processing fees will be charged. The General Terms and Conditions of Byjuno AG apply. By placing the order, the Customer agrees to this assignment of claims.

    Zoo Zurich reserves the right to exclude Customers from individual payment options or to insist on payment in advance without stating reasons.

    In the event of late payment by the Customer, Zoo Zurich may charge interest on arrears as well as reminder fees.

    The Products delivered to the Customer shall remain the property of Zoo Zurich until payment has been made in full.

    6. DELIVERY, OBLIGATION TO INSPECT, NOTICE OF DEFECTS AND RETURNS

    Deliveries will be made within 5-7 working days by post (shipping method: Post Economy) to the address specified by the Customer in the order within Switzerland and to the Principality of Liechtenstein. The shipping costs to foreign countries are CHF 35.00. An order from abroad is only possible on prepayment. As Switzerland is not a member of the EU, additional VAT and customs duties will be charged in the country of the purchaser. The invoice will be sent by e-mail or by post. With the dispatch, benefit and risk are transferred to the customer, as far as this is legally permissible.

    If the delivery cannot be delivered or if the Customer refuses to accept the delivery, Zoo Zurich may terminate the contract after notifying the Customer by e-mail and setting a reasonable deadline, as well as charging the Customer for the costs of the handling.

    The Customer is obligated to inspect the delivered goods immediately upon receipt of the delivery and to notify Zoo Zurich immediately in writing by letter or e-mail to the address in theimprint of any defects for which Zoo Zurich is liable.

    Return shipments to Zoo Zurich shall be made for the account and at the risk of the Customer. The Customer may return orders from the online shop to the address given in theimprint as follows:

    Admission vouchers& gift cards
    Admission vouchers and gift cards can be returned within seven working days.

    Zoo shop products
    Zoo shop products must be returned in their original packaging within seven working days if they are not liked or not the right size.

    Zoo Zurich face mask
    As the Zoo Zurich face mask is a hygiene article, it cannot be returned.

    If the inspection by Zoo Zurich reveals that the goods do not have any detectable defects or that they are not covered by the manufacturer's warranty, Zoo Zurich may charge the Customer for the effort involved in returning the goods or for their possible disposal.

    7. RIGHT OF REVOCATION

    The Customer is granted a right of withdrawal for 8 calendar days after receipt of the goods. The deadline shall be deemed to have been met if the Customer sends the written revocation by e-mail or letter to Zoo Zurich within the deadline. The revocation does not require a statement of reasons.

    The exercise of the right of revocation shall result in a reversal of the contract. The Customer must return the goods within 8 calendar days in their original packaging, complete with all accessories and together with the delivery note to the address given in the legal notice. Returns to Zoo Zurich are at the expense and risk of the Customer. Any payment already made shall be refunded to the Customer within 30 calendar days, provided Zoo Zurich has already received the goods back or the Customer can provide proof of shipment.

    Zoo Zurich reserves the right to claim reasonable compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice the Customer.

    No right of cancellation shall be granted in the following cases:

    • If the contract has an element of chance, namely because the price is subject to fluctuations over which the supplier has no control.
    • If the contract concerns a movable item which, due to its nature, is not suitable for return or may spoil quickly;
    • If the object of the contract is a movable item that has been manufactured according to the consumer's specifications or is clearly tailored to personal needs;
    • If the contract concerns digital content and this content is not provided on a fixed medium or if the contract is to be performed in full by both parties immediately;
    • Where the contract concerns a service and the contract is to be performed in full by the supplier, with the prior express consent of the consumer, before the expiry of the withdrawal period.
    • In the fields of accommodation, transport, supply of food and drink and recreation, if the supplier undertakes, at the time of conclusion of the contract, to supply the services at a specified time or within a specified period.

    8. WARRANTY

    Zoo Zurich shall endeavor to deliver goods of flawless quality. In the event of defects notified in due time, Zoo Zurich shall warrant that the item purchased by the Customer is free of defects and functional during the statutory warranty period of generally two years from the date of delivery. It is at the discretion of Zoo Zurich to provide the warranty by repairing the item free of charge, by replacing it with an equivalent item or by refunding the purchase price. Further claims are excluded.

    Normal wear and tear as well as the consequences of improper handling or damage by the Customer or third parties as well as defects caused by external circumstances are not covered by the warranty. The warranty for consumable and wear parts (e.g. batteries, rechargeable batteries, etc.) is also excluded.

    Zoo Zurich cannot give any assurances or guarantees that the data is up-to-date, complete and correct, or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, no representation or warranty is made that the use of the Website will not infringe rights of third parties not owned by Zurich Zoo.

    9. LIABILITY

    Zoo Zurich excludes all liability, irrespective of its legal basis, as well as claims for damages against Zoo Zurich and any auxiliary persons and vicarious agents. In particular, Zoo Zurich shall not be liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the Customer. Further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.

    In the Zoo Zurich Online Shop, hyperlinks are used solely to facilitate the Customer's access to other websites. Zoo Zurich can neither know the content of these web offers in detail nor assume liability or any other responsibility for the content of these websites.

    3. TICKET PURCHASE

    By purchasing tickets at the Zoo Zurich Online Ticket Shop, Online Ticket Purchasers accept the safety, access and other regulations of the Zoo Zurich. Online Tickets may only be purchased in the official Zoo Zurich Online Ticket Shop. Furthermore, ticket purchasers acknowledge that they may be excluded from the Zoo Zurich without compensation in the event of non-compliance with such regulations. Possible further regulations are mentioned in the «GTC Zoo Zürich AG» as well as in the «GTC Events Zoo Zürich AG & Zoo Restaurants GmbH». Furthermore, the Purchasers acknowledge that the validity period of the tickets cannot be extended. Tickets will not be exchanged or refunded.

    Zoo Zurich Online Tickets are transferable unless otherwise stated. Online Tickets must be protected from wear and tear and may not be altered or copied. The validity of the Online Ticket is checked electronically (by means of a barcode) by the Zoo Zurich at the entrance. Holders of Online Tickets with reduced rates (youths, children) must be able to prove this with a valid ID.

    Online tickets with a damaged microstructure or barcode lose their validity, but can be printed out again from the personal customer account in the Zoo Zurich Online Ticket Shop. In the event of duplicates or fraudulent actions (resulting in the reporting of the matter to the authorities), Zoo Zurich reserves the right to reject all tickets, refunding the price to the rightful holders.

    4. DATA PROTECTION

    The applicable data protection regulations can be found in the Data Protection Declaration of Zoo Zurich. The Privacy Policy is an integral part of the GTC Zoo Zürich Online Ticket Shop.

    5. LIABILITY

    To the extent permitted by law, the zoo excludes any liability for damages (personal injury or bodily harm) incurred directly or indirectly in connection with the purchase of an online ticket, i.e. the visit to the zoo, a related service or the purchase of goods, irrespective of the legal grounds on which the damages are claimed.     These General Terms and Conditions (GTC) of Zoo Zürich AG govern the use of the zoo Wifi (WLAN) by zoo visitors.

    2. SERVICE PROVIDER

    Zoo Zürich AG provides the zoo visitor with access to the Internet on the zoo premises within the scope of its technical, operational and economic possibilities. Zoo Zürich AG cannot guarantee data transmission quality or freedom from interference when providing its services. zoo visitors have no claim to the provision of zoo WiFi on the zoo premises. In the event of excessive use by a zoo visitor, Zoo Zürich AG may limit the bandwidth for the customer or exclude the customer from the service. Zoo Zürich AG is entitled to block certain services or websites at any time.

    3. COSTS

    Zoo Wifi is provided free of charge during the opening hours of the Zoo Zurich.

    4. DUTIES AND OBLIGATIONS OF THE CUSTOMER

    The use of the internet services is at the sole responsibility of the customer. The zoo visitor is solely responsible for the security of his/her terminal device (by means of which he/she uses the Wifi network). The zoo visitor is obliged to use the service or services of Zoo Zürich AG properly and lawfully. The zoo visitor is expressly forbidden to misuse the possibility of accessing the Internet or to have it misused or to use the service to commit illegal or punishable acts. This also includes the use of content or references to external content (links / hyperlinks) that violate legal regulations or official orders - in particular due to pornographic, violence-glorifying or racist content or design. The same applies in the case of infringement of ancillary copyrights (in particular trademark and copyright), the sending of statements damaging to reputation, junk mail or mass mail (spam) as well as anti-competitive actions. The misuse of the service for the purpose of damaging other Internet participants, peer-2-peer or similar networks or platforms for the purpose of offering, downloading, brokering, etc. of copyrighted content (e.g. music, videos, films, e-books, etc.) is prohibited for the zoo visitor. If the zoo visitor makes publications on the Internet, he/she is solely responsible for the content.

    In the aforementioned cases of violation of legal regulations or official orders, the zoo Visitor shall indemnify Zoo Zürich AG against all claims asserted by third parties against Zoo Zürich AG on the basis of such violations. In such cases, the zoo Visitor is fully liable to Zoo Zürich AG for recourse. Zoo Zürich AG is entitled to charge the zoo visitor for all costs incurred as a result of improper or inappropriate use of the installed facilities or the subject matter of the Agreement.

    The zoo visitor assumes responsibility for ensuring that the terminal device used by him/her and the software thereon are free of viruses and other malware. In the event of sale, theft or other loss, the zoo visitor is also obliged to immediately delete his/her terminal device from the Zoo Zurich registration. The deletion is carried out on the basis of an e-mail sent by the Customer to zoo@zoo.ch, stating the telephone number. All registered devices (see also section 5 Registration) will be deleted. If the zoo visitor violates the above obligations, he shall compensate the direct and indirect damage caused thereby.

    If the Customer violates any of the above duties or obligations, Zoo Zürich AG is entitled to block Internet access or to take immediate technical measures, insofar as these are necessary to ensure trouble-free operation of the service. The Customer may be excluded from using the Service with immediate effect.

    5. REGISTRATION

    In order to use zoo Wifi, the zoo visitor must register his/her terminal device using the form provided. By providing his/her gender, first name, surname and e-mail address, the zoo visitor grants Zoo Zürich AG permission to use this data for marketing purposes (in particular for sending out newsletters). It is possible to register several end devices per zoo visitor for the use of zoo Wifi. The registration is valid for 12 months. The Customer may revoke his/her participation in zoo Wifi at any time by sending an e-mail to zoo@zoo.ch. From the time of revocation, no more personal data will be collected or processed. Zoo Zürich AG reserves the right to request a new registration from individual or all Customers at any time. By logging into the system, the Customer is requested to accept these General Terms and Conditions and declares that he/she has taken note of the Privacy Policy.

    6. DATA PROTECTION

    The applicable data protection provisions can be found in the Data ProtectionDeclaration of Zoo Zurich. The Privacy Policy is an integral part of the GTC zoo Wifi.

    7. LIABILITY

    To the extent permitted by law, Zoo Zürich AG excludes liability for itself, its auxiliary persons and for commissioned third parties. It is liable only up to the amount of the proven damage. It is not liable in cases of force majeure, for consequential damage and loss of profit. Zoo Zürich AG only provides access to the Internet via Wifi. Zoo Zürich AG assumes no liability for the functioning of the Internet access at all times, nor for the uninterrupted or trouble-free functioning of the Internet access service or other Internet services, nor for any damage to the hardware or software of the Customer's terminal equipment or any other property or other damage resulting from the use of the hotspot. To the extent permitted by law, Zoo Zürich AG shall not be liable for the authenticity and integrity of data stored or transmitted via its system or the Internet. Likewise, to the extent permitted by law, liability is excluded for the accidental disclosure, damage, loss or deletion of data sent/received or stored. Furthermore, Zoo Zürich AG shall not be liable for any damage caused by misuse of the connection (including viruses) by third parties.

    8. INVOLVEMENT OF THIRD PARTIES

    Zoo Zürich AG may at any time engage third parties to provide its services. In doing so, Zoo Zürich AG shall remain responsible for compliance with the contractual agreements and the statutory provisions.

    9. CHANGES TO THE TERMS AND CONDITIONS

    Zoo Zürich AG reserves the right to amend the GTC at any time. Zoo visitors will be informed of any changes to the GTC in an appropriate manner.

    10. SEVERABILITY CLAUSE

    If individual provisions of these GTC prove to be invalid or unlawful, the validity of the GTC shall not be affected thereby. In this case, the provision in question shall be replaced by a valid provision that is as economically equivalent as possible.

    11. APPLICABLE LAW AND PLACE OF JURISDICTION

    Swiss law is exclusively applicable to the contractual relationship. The place of jurisdiction is Zurich.
